1. Acceptance of Terms

By accessing or using EarlyCRO ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

EarlyCRO provides a conversion rate optimization platform including A/B testing, heatmaps, session recordings, form analytics, and related services. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To use EarlyCRO, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or the age of majority in your jurisdiction
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Collect personally identifiable information without proper consent
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to send spam or unsolicited communications
• Reverse engineer or attempt to extract source code from the Service
• Use the Service on websites containing illegal content

5. Payment Terms

EarlyCRO is free during early access. We'll give you at least 30 days notice before charging for anything.

6. Data Ownership

You retain all rights to your data. By using the Service, you grant us a limited license to process your data solely to provide the Service. We do not sell your data to third parties.

You are responsible for ensuring you have the right to collect and process data from your website visitors in compliance with applicable laws (including GDPR, CCPA, etc.).

7. Intellectual Property

The Service, including all software, designs, and content, is owned by Spruik and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Availability

EarlyCRO is in early access, so we don't offer an uptime guarantee or service credits. We'll tell you about major outages.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARLYCRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims under these terms shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded.

10. Indemnification

You agree to indemnify and hold harmless EarlyCRO and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

11. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will be revoked
• Your data will be retained for 30 days, then deleted
• You may request an export of your data before deletion

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.
